Cornwall Roof Tents Rental Agreement Terms

1. Definitions

  • Rental Equipment ("the Equipment"): Refers to the Roof Tent(s) and any associated accessories as specified in the client’s order on the Cornwall Roof Tents website.

  • Rental Period: The duration from the scheduled collection of the Equipment by the Client to the agreed return time and date, as specified in the booking confirmation.

2. Agreement Acceptance

  • Acceptance: By placing an order via online, email, or another approved method, the Client agrees to abide by the terms outlined in this rental agreement.

3. Reservation and Cancellation Policy

  • Initial Booking and Deposit: A non-refundable deposit secures the rental dates, deducted from the total rental cost.

  • Grace Period for Advanced Bookings

    • Booking Flexibility: Clients who make a booking more than a month in advance have a 7-day grace period to cancel for a full refund of the deposit. This grace period is designed to allow clients to finalize their associated travel plans, such as securing campsite reservations.

  • Advisory Check on Vehicle Compatibility:

    • Consultation Within 24 Hours: Upon booking, clients are advised to provide details of their vehicle and roof bars within 24 hours. Cornwall Roof Tents will assess the information and advise on the compatibility of the client’s vehicle with the rented equipment.

    • Client Decision Based on Advice: If Cornwall Roof Tents identifies any potential compatibility issues, the client will be informed and may choose to either proceed with or cancel the booking. If the client opts to cancel within this 24 hour period, based on our advice, they will receive a full refund of their deposit.

  • Alternative Offerings: If the specific tent reserved is unavailable due to unforeseen circumstances, such as damage from a previous renter, Cornwall Roof Tents will:

    • Offer a comparable tent as an alternative, subject to the client’s agreement.

    • If no suitable alternative is available or acceptable to the client, Cornwall Roof Tents reserves the right to cancel the booking and provide a full refund, including the deposit.

  • Flexible Rescheduling: Cancellations at least 7 days prior allow deposit transfer to a new date within three months, subject to availability.

  • Late Cancellations: Cancellations within 7 days of the start date result in deposit forfeiture.

4. Security Deposit and Photo ID

  • Security Deposit: For rentals up to 7 days, a security deposit will be pre-authorized on a credit/debit card. For longer rentals, the security deposit must be provided via cash or bank transfer. This is to cover any potential damages or losses incurred during the rental period.

  • Photo ID Requirement: A valid driving license or passport must be presented at the time of equipment collection. Cornwall Roof Tents will take a photo of the ID for record-keeping, which will be deleted upon the safe return of the rented items. Failure to provide a valid photo ID will result in the cancellation of the rental and forfeiture of the deposit.

5. Final Payment

  • Payment Methods: Payments via credit/debit card, cash, or bank transfer are accepted. Payments must clear before the Equipment collection, preferably one day prior.

6. Client Responsibilities

  • Vehicle Requirements: The client’s vehicle must have roof bars rated for a minimum weight specified by the roof tent manufacturer (typically 60kg). The vehicle height must not exceed the dimensions of standard vans such as the Transporter/Transit Custom (about 2m). For vehicles taller than these models, please contact Cornwall Roof Tents prior to booking to confirm suitability.

  • Physical Fitness: Clients must be physically able to climb a ladder safely to access the tent. It is imperative that all clients assess their own fitness and comfort levels with such activities before using the equipment.

  • Usage Instructions: Instruction on the safe use of the equipment will be provided at the time of collection. Clients are expected to follow these instructions to ensure their own safety and the integrity of the tent.

7. Insurance and Liability

  • Equipment Insurance: The tents are insured against damage under normal use conditions, in accordance with the manufacturer's guidelines. This includes avoiding usage in excessively high winds and ensuring the tent is not left unattended at any time. Unattended tents are susceptible to theft and damage, which could negate the insurance coverage provided.

  • Supervision Requirement: The client is required to ensure that the tent is supervised at all times when set up. Failure to supervise the tent may result in liability for any loss or damage incurred during the period of unsupervised use.

  • Theft: In the event of theft, the client is required to file a police report, obtain a crime reference number, and inform Cornwall Roof Tents immediately. Liability may extend to the full replacement value of the equipment if the theft occurred during a time of negligence or if the equipment was left unattended.

  • General Liability Waiver: Cornwall Roof Tents is not responsible for any personal injuries, property loss, or damage sustained as a result of operating or using the rented equipment. Clients must acknowledge these risks and adhere to all safety instructions provided.

  • Roof Bar Failure: We are not liable for any damage to personal or third-party property caused by the failure of a client’s roof bars, whether during transit or while stationary. Clients are advised to ensure their roof bars are properly secured and meet the equipment’s requirements before embarking on their journey.

8. Setup, and Return

  • Setup and Inspection: Cornwall Roof Tents will set up the Equipment at the agreed-upon time and perform a walkthrough with the Client to ensure understanding and satisfaction. The Client is required to be present during setup and return to facilitate inspections.

  • Condition and Return: The Equipment must be returned in the same condition as when collected, barring normal wear and tear. Fees will be charged for late returns, damages, or excessive soiling.

9. Prohibited Activities

  • Restrictions: No smoking in or around the Equipment. Pets and children must be supervised to prevent damage.

11. Force Majeure

  • Weather and Natural Events: Cornwall Roof Tents is not liable for delays or failures in performance resulting from acts beyond our control, including weather phenomena and other natural disasters. Efforts will be made to reschedule or refund bookings in such cases.

12. Legal and Dispute Resolution

  • Jurisdiction: Disputes resolved in the nearest small claims court under the United Kingdom laws.

  • Entire Agreement: This document constitutes the entire agreement between Cornwall Roof Tents and the Client, superseding prior discussions, emails, or communications.
